These Terms of Service ("Terms") form a legally binding agreement between you ("User", "you") and SnowFairy AI Labs ("SnowFairy", "we", "us") governing your access to and use of the SnowFairy AI IntelliRecover desktop application ("Software") and associated online services. By downloading, installing, activating, or using the Software in any way, you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree, you must not download, install, or use the Software.
SnowFairy AI IntelliRecover is a Windows-only desktop application. It is designed to help users recover deleted, lost, or inaccessible files from hard drives (HDD/SSD), USB drives, memory cards, NAS drives, and disk images. macOS, Linux, Android, iOS and other platforms are not supported.
Additional modules — including email recovery, WhatsApp recovery, RAID reconstruction, cloud drive recovery, disk cloning, disk imaging, and AI image enhancement — are available depending on your license tier.
Subject to your compliance with these Terms and timely payment of applicable fees, SnowFairy grants you a limited, non-exclusive, non-transferable (except as permitted in Section 10), non-sublicensable, revocable license to install and use the Software on the number of Windows devices specified for your plan, solely for your own lawful data recovery purposes.
No title, ownership, or intellectual property rights in the Software are transferred to you. The Software is licensed, not sold.
The Software is offered in the following plans. All plans are for Windows only. Prices may be shown in USD or local currency depending on your checkout region. Any applicable taxes (GST, VAT, sales tax) are shown before you confirm payment and are handled by the merchant of record or SnowFairy AI Labs depending on the checkout route.

Failed recovery due to device condition or overwritten data is not grounds for a discretionary refund, except where mandatory local law applies or the Software itself is defective or not as described. Personal plans (Rescue, Standard, Pro, Elite) are licensed for personal, non-commercial use only. "Commercial use" means recovering data on behalf of a paying client, as part of a professional service, or in a business context where the recovery provides direct or indirect revenue.
Using a personal plan for commercial client work is a material breach of these Terms and may result in immediate license revocation without refund. If you perform commercial recovery services, you must purchase a Commercial Starter plan or higher.
Annual commercial plans permit use on the specified number of Windows PCs within a single organisation. Sub-licensing or using one license across multiple client organisations is not permitted without a separate Enterprise agreement.
Activation: Each License Key may be activated on up to the number of Windows PCs specified for your plan. On first activation, the Software binds to a hardware fingerprint (a one-way SHA-256 hash of device identifiers) to enforce per-device limits.
Transfer: Each lifetime license may be transferred to a replacement device up to one time per 12-month period by contacting support@snowfairy.ai. Annual plan administrators may manage device assignments via the account portal.
Grace period: All paid plans include a 15-day grace period after expiry, during which the Software continues to function. This allows time to renew without service interruption.
Revocation: We may revoke a License Key if it is found to be used in violation of these Terms — including key sharing, excess device activations, commercial misuse on a personal plan, or confirmed fraudulent activity. Revocation without refund applies where the violation is material. Indian Contract Act 1872 §39
The free plan is available without payment or account creation. Recovery is capped at 500 MB per session. File preview is available for all file types. We may adjust free plan limits with reasonable notice. The free plan is provided "as is" with no support commitments.
Payments may be processed either by an authorised payment gateway or by a merchant of record, depending on your country, currency, card type, and checkout route. The applicable processor or merchant of record will be identified at the point of purchase before you confirm payment.
Where a merchant of record is used, that merchant of record is responsible for collecting and remitting all applicable taxes (VAT, GST, sales tax) in your jurisdiction, and payment-related support is handled by them. Where an authorised payment gateway is used, SnowFairy AI Labs Private Limited remains the seller of record and is responsible for tax collection, remittance, and customer support according to applicable law.
Payment routing & failed payments: We may use multiple authorised payment processors or merchants of record depending on your country, currency, card type, and transaction reliability. A transaction is complete only when the payment processor confirms successful payment and a License Key is issued to your email. Declined, failed, abandoned, or bank-review transactions do not create a license and are not treated as purchases. If your bank declines a transaction, you may need to confirm with your bank that you recognise the purchase from SnowFairy AI Labs Private Limited and then retry checkout. We cannot override or approve bank declines.
The Software operates two distinct data streams, described fully in our Privacy Policy:
Stream A — Mandatory (License, Fraud Prevention & Dispute Evidence): Collected during every session regardless of your settings. Includes account identity, license tier, device fingerprint hash, session timestamps, features used, and recovery evidence: the number of files recovered and up to 100 recovered file names per session, retained for chargeback and dispute defence. File contents are never transmitted. This stream is active because without it we cannot enforce license terms or defend against fraudulent claims.
Stream B — Optional (Anonymised Benchmark Telemetry): Disabled by default. Opt in via Settings → Privacy → Analytics. Contains zero file names, zero file paths, zero file contents, and zero personally identifiable information. Used solely for aggregate performance benchmarking. Raw entries are auto-deleted after 30 days.
By using the Software you explicitly consent to Stream A data collection as a condition of use, as disclosed in the in-app Terms and this agreement. This is consistent with the lawful basis of contract performance and legitimate interest in fraud prevention. GDPR Art. 6(1)(b)(f) DPDP Act 2023 §4 IT Act 2000 §43A
A chargeback is a payment reversal filed through your bank or card network without first requesting a refund through our official process. We treat chargebacks filed in bad faith — particularly where data was successfully recovered — as potential fraud.

The Software, its source code, algorithms, user interface design, brand names, logos, trademarks ("SnowFairy AI™", "SnowFairy AI Labs™", "IntelliRecover™"), and documentation are the exclusive intellectual property of SnowFairy AI Labs, protected under:
Third-party open-source components (including Real-ESRGAN and Waifu2x) are used under their respective licenses. A complete list is available in THIRD_PARTY_LICENSES.txt in the Software's installation directory.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.
WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT: (A) ALL OR ANY PARTICULAR FILES WILL BE RECOVERED; (B) THE SOFTWARE WILL OPERATE WITHOUT ERROR ON YOUR SPECIFIC HARDWARE CONFIGURATION; (C) ALL FEATURES WILL BE AVAILABLE AT ALL TIMES; OR (D) THE SOFTWARE WILL MEET YOUR SPECIFIC REQUIREMENTS. RECOVERY OUTCOMES DEPEND ON FACTORS ENTIRELY OUTSIDE OUR CONTROL. Indian Contract Act 1872 §62
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SNOWFAIRY AI LABS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS, BUSINESS INTERRUPTION, LOSS OF GOODWILL, OR COST OF SUBSTITUTE GOODS OR SERVICES, ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SOFTWARE.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS (INCLUDING EU MEMBER STATES, THE UK, AND CERTAIN INDIAN CONSUMER PROTECTION PROVISIONS) DO NOT PERMIT FULL EXCLUSION OF LIABILITY FOR DEATH, PERSONAL INJURY, OR FRAUD CAUSED BY OUR NEGLIGENCE. You agree to indemnify, defend, and hold harmless SnowFairy AI Labs and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your violation of any applicable law or third-party rights; (c) your use of the Software to access data without lawful authority; or (d) any fraudulent chargeback or refund claim you initiate. Neither party shall be liable for delays or failures in performance resulting from causes beyond that party's reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, civil unrest, government orders, pandemic, power failures, internet outages, or failures of third-party infrastructure providers (including Google Firebase, the authorised payment processor, or Groq). In such circumstances the affected party will notify the other as soon as practicable and resume performance as soon as reasonably possible.
We may release updates, patches, and new versions. Bug fixes and security patches are provided free to all paid license holders. New major features may require a plan upgrade. We will give reasonable notice of changes that materially reduce features available to your existing plan. We reserve the right to discontinue support for older Software versions with at least 90 days' notice.
We may update these Terms at any time. We will notify you of material changes via our website and, where practicable, by email or in-app notification at least 14 days before they take effect. Continued use after that date constitutes acceptance. IT Act 2000 §85B
These Terms remain in effect until terminated. We may suspend or terminate your license immediately upon material breach of these Terms — including but not limited to: license key sharing, commercial use on a personal plan, reverse engineering, or fraudulent refund/chargeback activity. Upon termination, all rights granted to you cease, and you must uninstall the Software and destroy all copies. No refund is issued for termination due to breach.
You may terminate at any time by uninstalling the Software. Sections 14, 15, 16, 17, 18, 22, and 24 survive termination.
These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute shall first be attempted to be resolved by good-faith negotiation (email: support@snowfairy.ai) within 30 days. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
Nothing in this clause prevents either party from seeking urgent injunctive or interim relief in any competent court to prevent irreparable harm, including enforcement of intellectual property rights.
These Terms apply worldwide. Every country has its own consumer protection, digital content, cancellation, refund, warranty, privacy, and unfair-contract laws. Nothing in these Terms limits or excludes any right that cannot legally be limited or excluded under the law of your country of residence. If a mandatory local law gives you stronger rights than these Terms or our Refund Policy, the mandatory local law controls to that extent only.
For digital software downloads, some jurisdictions provide a cooling-off or withdrawal period. Where the law allows it, this right may end once you ask us or the payment processor to provide immediate access to the Software, receive the license key, start the download, activate the Software, or otherwise begin using the digital content — after acknowledging that your cancellation right may be lost as a result. If you have not done any of those things and are within the applicable withdrawal window, contact us at support@snowfairy.ai and we will process your withdrawal.
Examples of mandatory rights that apply in specific jurisdictions (this list is illustrative, not exhaustive — your local law governs):
Severability: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and SnowFairy regarding the Software and supersede all prior agreements, representations, or understandings.
No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
These Terms are a living document. As our product, technology, and the legal landscape evolve, we may need to add, clarify, or update provisions. We reserve the right — without limiting your rights under Section 23 — to update these Terms to address any of the following as they arise:
